… in China. China is world’s #5 in women’s golf. However, no Chinese men are in the world top 200 players. Under currents for why the ruling Chinese Communist government is closing golf courses and banning new ones in spite of the Chinese golf boom? Probably not. Government officials should not be able to afford to play golf on their salaries. If they can’t, why should anyone else be allowed to play? Senior officials who play golf or have golf memberships are under probe for corruption and the public is encouraged to turn violators in.

Don Smaltz Intended Comments So Rudely Interrupted

Don Smaltz’s comments at the ArrowCreek Board meeting on April 14, 2015, were very rudely interrupted by rogue, disrespectful persons. Here is his intended presentation:

Members of the Board, before I begin, let me tell you that I will be explaining why the opinion letter issued by Eva Segerblom on March 3, 2015 is incorrect, as a matter of fact and as a matter of law.

I will also tell you why it is important – to all ArrowCreek members – that the Board must follow the Roberts Rules of Order in conducting their Board meetings.

Therefore, I am requesting that my remarks not be limited by your 3-minute rule, but that I have at least 8 minutes to conclude these remarks.

1st: WHAT IS MY POINT?

The Board is currently following an unlawful set of procedural rules.

By a Resolution passed on November 1, 2011 the Board created its own special Parliamentary Rules of Procedure. That Resolution is unlawful, because the Board may not pass a Resolution which is in conflict with a By-Law passed by the members. A By-Law trumps any resolution by the Board. (Note Exhibit 1 – Board of Director’s Resolution Pertaining To Parliamentary Procedure)

2nd: WHAT IS THE AUTHORITY FOR MY STATEMENT THAT THE BOARD’S PROCEDURE IS UNLAWFUL?

The Bylaws for this Association were enacted May 9, 1997. Section 2.05 entitled Conduct of Meetings provided that the chairman: shall conduct each such meeting in a businesslike and fair manner, but shall not be obligated to follow any technical, formal or parliamentary rules or principles of procedure. ( Note Exhibit 2 – Section 205 of AHOA Bylaws dated 1997)

However, a year later – in June 1998 – By-Law 5.07 was passed by vote of the ACHOA members. It changed Rule Section 2.05 and required Robert’s Procedural govern stating “…all meetings of the Association shall be conducted in accordance with the procedural rules specified in the most current edition of Robert’s Rules of Order.”

[As recently as 5 months ago, Eva Segerblom’s office issued a legal opinion stating: the “By-Laws may be amended or repealed by approval of [a] majority of the regular members…” ]

3rd: WHY DOES IT MATTER WHAT PROCEDURE THE BOARD FOLLOWS?

The object of Robert’s Rules is to provide rules of procedure that permit the assembly to transact business legally and to control the conduct of its members in an orderly procedure, recognizing: that all members are equal; the right of the minority to be heard on questions; the right of the majority to govern, so that there is justice for all.

So these rules of procedure promote: Order, Equality, Rights of Minority to be heard, and Rights of Majority to govern.
Within the time constraints imposed by this Board, I will give you just two examples of the difference between the Board’s own rules and Robert’s Rules:

1. The 3-minute rule – No matter how important the subject, there is an arbitrary limit of 3 minutes for member comments. Robert’s Rules requires that a member have ample time to present a position, within reasonable limits.

2. A member has no right to have a motion placed on the agenda of a Board meeting. Robert’s Rules says any member may move to add an agenda item or propose any change to the agenda before the Board meeting.

FINALLY: WHY IS SEGERBLOM’S OPINION LETTER INCORRECT AS A MATTER OF FACT AND LAW? For at least three reasons:

1st: The opinion quotes Nevada Revised Statutes section 116.3106(2), which authorizes a Board to adopt its own rules “except as otherwise provided in the bylaws.” In our Association, there is a specific By-Law 5.07 mandating that the Board follow Robert’s Rules. She ignores it!

2nd: The opinion goes on to quote By-Law 2.05, but uses the language in the By-Law as it originally appeared on May 13, 1997. The opinion letter completely ignores the fact that, the next year, this provision was effectively repealed by 5.07 which requires that the Board follow the Robert’s Rules of Order.

3rd: the opinion attaches as authority a copy of page 486 of Robert’s Rules. However, that provision only authorizes a board to adopt its own special rules of order to the extent that those rules do not conflict with the Association’s rules, such as those in the By-Laws. ArrowCreek Needs A Community Strategic Plan

The HOA Board does not appear to have a Strategic Plan of any sort–short or long term planning is non-existent in many areas (OK. There is a Reserve Study and Budget. Roads are covered! But where is a PLAN?).  It seems like a poor way to run a railroad (business) to have no such plan in place.  And…with the current ArrowCreek (AC) demographic study taking place that seeks to identify amenities/activities we residents value, it seems like the perfect time to develop a Strategic Plan utilizing this information.

The Somersett Owners Association (SOA) Amenities Assessment Report, as Ron Duncan pointed out at the 4/14 ACHOA Board Meeting, is comprehensive and well done (which is probably why it cost $25K). Included in the report is some interesting information – facts that probably relate not only to Somersett residents, but could also be true for the AC community. The SOA Strategic Planning Committee is busy updating their plans. Where is the ArrowCreek Strategic Planning Committee? It isn’t listed on the Associa Committees & Groups page.

For example, on page 20 of the report, Recreation Trends are addressed. Like our concerns here in AC, it is pointed out that one of the core roles of an HOA is to maintain property values in an increasingly competitive environment. Amenities help give and keep competitive edge and keep property values up.  The study goes on to state amenities planning is critical because amenities incur a large portion of assessment dues ….

The study further points out there is a growing national awareness that lifestyle is one of the most potent treatments for public health issues.  Providing well-maintained trails and other outdoor and indoor exercise opportunities conveniently located within the community will be increasingly appealing to homeowners wanting a healthy lifestyle.

Forrest Patin, in several presentations last December, has related similar information. What our community needs is a plan to expand current recreational opportunities/amenities, not simply focus on golf, which meets the needs of a minority of our community.

Interestingly, comments in the report about ArrowCreek state: “AC has one 4,000 square foot recreational facility that sits on 20.5 acres. Because of long-range plans in place when the building was constructed, AC has AMPLE room to expand if needed.”  There are additional references in the report stating how much recreation area is available for development in AC.

Also of note:

Tahoe Donner (TD) in Truckee is referenced. It appears TD operates under the belief that good user data is key to successful amenities and capital planning, providing regular financial updates to members. TD has a very healthy financial planning process in place for operations and long-term planning projects and believes that good communication builds buy-in + homeowner trust.

We might learn from TD as AC seems to have little long-term planning in place and homeowner trust  and transparent communication from the Board is seemingly lacking.

In summary, there is much information to be gleamed from this report that could assist AC residents in increasing our property values. None of these amenities/ideas relate to a golf course.

Food for thought as we try to move forward in a helpful and positive manner…

What Is Truth?

Truth is not a universally same value for every person in this ArrowCreek community or even for the world. It is formed by life experiences, as CNA has said in previous dialogues with those in the community that declare only they have the truth.

The Truth is what you believe, profound as it may be.

From Philosophy Now, Mar/Apr 2015, the answers to “What is Truth?” are as varied as the perception of truth.

The one that clicks with the behavior experienced in ArrowCreek is this one from Robert Tables of Blanco, Texas:

Truth is interpersonal. We tell each other things, and when they work out we call them truths. When they don’t, we call them errors or, if we are not charitable, lies. What we take as truth depends on what others around us espouse. For many centuries European Christians believed that men had one fewer rib than women because the Bible says that Eve was created from Adam’s rib. Nobody bothered to count because everyone assumed it was true. And when they finally counted, it was because everyone agreed on the result that the real truth became known. Even when we are alone, truth is interpersonal. We express these truths or errors or lies to others and to ourselves in language; and, as Wittgenstein pointed out, there can be no private language.

But the most essential truth, the truth by which we all live our lives, is intensely personal, private. We might call this ‘Truth’, with a capital T. Even though each of us lives our life by Truth, it can be different for each person. Shall I believe and obey the Torah, the New Testament, the Quran, the Bhagavad Gita, the Zend Avesta, the Dhammapada? Or none of the above: shall I find my own Truth in my own way?

We thus need a community of seekers with a commitment to meta-Truth, recognizing that personal Truths are to be respected, even though any Truth will differ from someone else’s. But even in such a community, some beliefs would be acceptable, and others not: my belief that I am exceptional and deserve preferential treatment, perhaps because I alone have received a special revelation, is not likely to be shared by others. From within the in-group we look with fear and revulsion on those who deny the accepted beliefs. From outside, we admire those who hold aloft the light of truth amidst the darkness of human ignorance. And in every case it is we who judge, not I alone. Even the most personal Truth is adjudicated within a community and depends on the esteem of others.

“NateStrong – Save in Seven” Blood Drive

Reno Friends! Mark your calendar for Tuesday, April 28th! It is with great excitement to announce that the parents at Hunsberger Elementary School are doing a Blood Drive in honor of Hunsberger’s little warrior Nate Christy.

Many of you know that our 9-year-old hero was admitted to the hospital in January for what seemed like a routine appendectomy. After experiencing life-threatening complications, Nate endured seven surgeries, three blood transfusions and spent nearly six weeks at Renown’s Pediatric Intensive Care Unit. The transfusions that helped save his life inspired him to “pay it forward” by hosting a blood drive of his own.

The “NateStrong – Save in Seven” Blood Drive will take place at Hunsberger Elementary School (2505 Crossbow Court, Reno NV 89511) on Tuesday, April 28, 2015 from 2:00pm to 7:00pm. United Blood Services of Reno will staff the drive with mobile units and will also offer a complimentary Cholesterol Test with every blood donation.

The event will include festivities for the entire family, including First Responder vehicles from the Reno Fire Department and the Washoe County Sheriff’s Office. There will also be snacks, giveaways and a grand prize drawing of a limousine ride and lunch with Nate.

If you are not a candidate for giving blood, there are other ways to participate! We would welcome donations of cookies and juice boxes the day of the event, and we need help posting flyers throughout town. If you own a business and would be open to displaying a poster in your window or on a bulletin board, please let me know!

The number seven is symbolic to this drive:
• 7: The number of surgeries Nate endured
• 7: The number of actual minutes it takes to donate blood
